A hearing to have charges in the Jonathan Bacon murder thrown out continues into its second week.

A hearing to have charges in the Jonathan Bacon murder thrown out continues into its second week.

The lawyers for Jujhar Khun-Khun, Michael Jones, and Jason McBride are arguing there have been unreasonable delays and it's taken too long to go to trial.

The application is based on a recent Supreme Court of Canada ruling that says trials must be concluded within 30 months after charges are laid.

The three men were arrested and charged with first-degree murder in 2013, almost two years after gangster Jonathan Bacon was fatally shot outside the Delta Grand Hotel in Kelowna.

The hearing started on May 15 and is expected to continue this week.

The trial is tentatively scheduled to start on May 29, pending when the hearing ends and when the judge makes a decision.
