A Peachland man accused of breaking into a townhouse and sexually assaulting two women has been declared not guilty.
39-year-old Shea Gardecki was first arrested back in August of 2016 following a 9-1-1 call from a nearby townhouse on Highland Drive North in Kelowna.
The two women who accused Gardecki of the assaults said he had broken into their townhouse and crawled onto a mattress where they were both sleeping, proceeding to sexually touch them before they woke up and told him to leave.
Gardecki was taken into custody moments after the alleged incident took place, and was released shortly afterwards on bail until the trial began this month.
After an 8-day trial and over a day of deliberations, the jury, consisting of 6 men and 6 women, delivered a verdict of not guilty to the court on Friday afternoon.
Prior to the deliberations, the defense urged the jury to consider the lack of evidence at the scene of the alleged incident, namely fingerprints and DNA.
