A Kelowna man's bid to have charges against him dropped because of an unreasonable delay has been denied.
32-year-old Shelden Harris is facing 5 counts of possession for the purpose of trafficking in connection to an October 2014 police raid which resulted in the seizure of $600,000 worth of drugs.
On the first day of his trial on Monday, his defence filed an application to have the charges thrown out, arguing it's taken more than 30 months to go to trial - a time limit set by the Supreme Court of Canada in its Jordan ruling last year.
On Tuesday, a Kelowna judge found the trial was still within the 30 months, ruling the start date for the time limit began when charges against Harris were sworn, in December 2014, and not when he was arrested two months earlier.
The trial for Harris and another man charged in the 2014 raid, Tyson Still, is now underway and expected to end Friday.
Two other people facing charges in connection to the raid, Casandra Diehl and Christopher Schiller, are yet to face trial.
