A new trial date has been set for a B.C. man who had his first-degree murder conviction overturned earlier this year.
Matthew Foerster, who was found guilty in 2013 of murdering 18-year-old Taylor Van Diest, was granted a new trial after the B.C. Court of Appeal found the judge incorrectly instructed the jury.
Van Diest was found beaten and strangled near a set of railway tracks in Armstrong on Halloween night in 2011.
During his trial, Foerster admitted he was respondible for the injuries to Van Diest, but argued he was guilty of manslaughter or second-degree murder.
Jury selection for the new trial in Kelowna is set for May 28th, with the 3-4 week trial set to start after.
